Civil Law
Originating in Italy and France, civil law is a legal system that has been embraced by many countries worldwide. The fundamental ideas of civil law are codified into a referable system that functions as the main source of law, and the system is intellectualized within the frameworks of French and Roman civil law. The common law system, which has its roots in medieval England, is frequently juxtaposed with the civil law system. In common law systems, the law originated from uncodified case law that resulted from judicial decisions, acknowledging earlier court decisions as legally binding precedent. In contrast, civil law is governed by legal codes. In the past, a civil law was the body of legal theories and systems that eventually came from the Corpus Juris Civilis. However, these legal theories and systems were greatly influenced by local, feudal, Napoleonic, Germanic, and canonical traditions, as well as by doctrinal currents like natural law, codification, and legal positivism. With its different versions in effect in about 120 nations, the Napoleonic Code is the most widely used legal system worldwide.
What The Civil Law is:
- a thorough set of guidelines and precepts that are typically organized into codes and are understandable to the public and legal professionals.
- a methodical framework that promotes collaboration, predictability, and order; it is built around a dynamic and logical taxonomy that originated in Roman law and is mirrored in the codes' structure.
- A flexible system where general provisions that allow for change are included in civil codes and avoid undue detail.
- a system that is mostly legislative in nature, but that allows the courts to use creative jurisprudence and interpretation to adapt laws to new demands and social changes.
Primary Feature of the Civil Law:
- Clearly stating obligations and rights will make remedies obvious.
- Citizen-friendly simplicity and accessibility, at least in those areas where it is legislated.
- The law's spirit, general principles, equality, and advance disclosure of regulations all play a role in filling in the silences in the code.
- Well-developed and, to some extent, internationally recognized academic theory that serves as a model for the courts and legislatures.
Where the Civil Law is found:
- The majority of jurisdictions in continental Europe have civil codes. Scotland is the only country in Great Britain where the civil law is still uncodified. Scandinavian countries are not considered civil law jurisdictions, even if they have civil codes.
- Louisiana and Quebec have civil codes in North America.
- Nearly every nation in Central and South America has a civil code.
- As a result, many Asian nations—including Kyrgyzstan, Lebanon, Indonesia, and Japan—have adopted civil codes.
- Many facets of the civil law traditions have been preserved in African nations that were previously colonized by continental European countries. While the Roman-Dutch law that was in use in South Africa was never codified, the Egyptian Civil Code has a great deal of influence throughout Africa and the Middle East.
- On some Pacific islands, particularly in the French territories of Tahiti and New Caledonia, there are traces of the civil law traditions.
- Mixed jurisdictions are those that have elements of European, African, and Asian law in addition to American civil law. These may include common law, customary law, or Islamic law.
Distinguish Civil Codes:
Napoleon's Code of 1804 is a well-known example of a civil law code. It bears the name of Napoleon, the French emperor. The Napoleonic code is made up of three parts:
- the Law of Persons
- The Property Law, and
- The Commercial Law.
The German Civil Code, also known as the BGB or Bürgerliches Gesetzbuch, is another well-known civil code that was implemented in the German Empire in 1900. The German Civil Code (1907) had a significant impact on other nations' civil codes, including those in Japan, South Korea, and Switzerland. It is split up into five sections:
- The General Part, covering definitions and concepts, such as personal rights and legal personality.
- Obligations, including concepts of debt, sale and contract;
- Things (property law), including immovable and movable property;
- Domestic relations (family law); and
- Succession (estate law).
